§ 1 Scope of Application
These General Terms and Conditions apply to all contracts concluded between CoreLogic Systems Limited, 21-25 Cheung Sha Wan Road, Cheung Fung Commercial Bldg, Flat 1506, 15/F, Sham Shui Po, Hong Kong (hereinafter referred to as "Provider") and the customer (hereinafter referred to as "Customer") via the online shop schneller-fahren.com.
Deviating conditions of the Customer are not recognized, unless the Provider expressly agrees to their validity in writing.
§ 2 Subject of the Contract
The Provider sells digital products, in particular tuning license codes for e-bikes and e-scooters, as well as physical tuning chips. The license codes are delivered by e-mail after purchase. Tuning chips are sent by post.
§ 3 Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to submit an offer. By sending the order, the Customer submits a binding offer to purchase. The contract is concluded when the Provider accepts the order by sending an order confirmation by e-mail.
§ 4 Prices and Payment
All prices are final prices. No sales tax in the sense of the German Sales Tax Act is shown, as the Provider is registered in Hong Kong.
The following payment methods are available: PayPal, Klarna, Credit Card (Visa/Mastercard), Apple Pay and Shop Pay. Payment is due immediately upon order.
§ 5 Delivery of Digital Products
Digital license codes are automatically delivered by e-mail to the e-mail address provided by the Customer immediately after payment is received. Delivery time is usually 1-5 minutes after payment receipt.
The Customer is obliged to provide a valid e-mail address and to check their spam folder. If the code is not received within 30 minutes, customer service must be contacted.
§ 6 Delivery of Physical Products
Physical tuning chips are sent by post. Delivery time is 3-10 working days, depending on the destination country. Shipping costs are displayed during the ordering process before the order is completed.
§ 7 Right of Withdrawal
The provisions of the separate withdrawal policy apply. For digital license codes: By ordering, the Customer expressly agrees that the Provider will begin executing the contract immediately. The Customer confirms their knowledge that the right of withdrawal expires upon delivery of the license code by e-mail (Section 356 (5) BGB).
§ 8 Terms of Use for Tuning Products
The tuning products sold by the Provider remove the factory speed limit of e-bikes and e-scooters. The Customer acknowledges and confirms upon ordering:
a) The use of tuned vehicles on public roads is not permitted. Use is exclusively on private property and at the Customer's own risk.
b) Tuning may void manufacturer's warranty and warranty claims against the vehicle manufacturer.
c) The Customer bears sole responsibility for compliance with applicable laws and regulations in their country or region.
d) The Provider accepts no liability for damages resulting from the use of tuned vehicles on public roads.
§ 9 Compatibility
The Customer is obliged to check the compatibility of the selected product with their vehicle before ordering. Compatibility information can be found on the respective product page. Customer service is available for uncertainties.
Returns due to lack of compatibility are excluded for digital products after delivery, provided that the compatibility information on the product page was correct.
§ 10 Reversibility
All tuning codes and tuning chips can be fully deactivated and reversed at any time. The Customer can restore the original condition of their vehicle without data loss.
§ 11 Warranty
The Provider guarantees that the digital license codes are functional at the time of delivery. If a code does not work, customer service must be contacted immediately. The Provider will provide a replacement code or refund the purchase price.
For physical tuning chips, the statutory warranty rights apply.
§ 12 Liability
The Provider's liability is limited to intent and gross negligence. This does not apply to damages resulting from injury to life, body, or health. Liability for slight negligence is limited to foreseeable, contract-typical damage.
The Provider is not liable for damages to the Customer's vehicle caused by improper application of the tuning products, provided that the supplied instructions were not followed.
§ 13 Data Protection
Information on the processing of personal data can be found in our separate privacy policy on schneller-fahren.com.
§ 14 Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr/
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 15 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as the Customer is a consumer with habitual residence in Germany. Mandatory consumer protection regulations of the state in which the Customer has their habitual residence remain unaffected.
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
